DISTANCE SALES CONTRACT

1. PARTIES

This Agreement is made between the undersigned (referred to as the "BUYER" hereinafter), residing at / address, and Munu Design, located at Soğucak Mah. 1381 Sok. B-Blok No: 2B Kuşadası/Aydın (referred to as the "SELLER" hereinafter), under the following terms and conditions.

2. DEFINITIONS

The terms below, as used in the implementation and interpretation of this Agreement, shall have the following meanings:

  • MINISTER: The Minister of Customs and Trade.

  • MINISTRY: The Ministry of Customs and Trade.

  • LAW: The Consumer Protection Law.

  • REGULATION: The Regulation on Distance Contracts.

  • SERVICE: Any consumer transaction other than the provision of goods, undertaken for a fee or other benefit, or undertaken with a commitment to be performed.

  • SELLER: A natural or legal person who provides goods to the consumer, or acts on behalf of or on account of someone providing goods, including public legal entities, for commercial or professional purposes.

  • BUYER: A natural or legal person who acquires, uses, or benefits from a good or service for non-commercial or professional purposes.

  • SITE: The website owned by the SELLER at www.munudesign.com.

  • ORDERING PARTY: A natural or legal person who orders a good or service through the SELLER’s website at www.munudesign.com.

  • PARTIES: The SELLER and the BUYER.

  • CONTRACT: This Agreement entered into between the SELLER and the BUYER.

The subject of this Agreement is the sale and delivery of the product that the BUYER has ordered electronically through the SELLER’s website, with the specifications and sale price indicated below, and the determination of the rights and obligations of the parties in accordance with the Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts dated November 27, 2014. The listed and advertised prices on the site are the sale prices. The advertised prices and promises are valid until updated or changed. Prices announced for a limited period are valid until the specified time. By accepting this distance sales agreement, the BUYER acknowledges that, if they confirm the order, they are under the obligation to pay the price of the product ordered and any additional charges such as shipping, taxes, and other specified fees, and they have been informed about this in advance.

7. PRODUCT/PRODUCTS INFORMATION SUBJECT TO THE AGREEMENT

7.1. The basic characteristics (type, quantity, brand/model, color, and number) of the product(s) are listed on the SELLER’s website. The BUYER may review the detailed product specifications.

7.2. The listed and advertised prices on the site are the sale prices. The advertised prices and promises are valid until updated or changed. Prices announced for a limited period are valid until the specified time.

8. GENERAL TERMS

8.1. The BUYER acknowledges, declares, and undertakes that they have read and understood the basic features, sale price, payment terms, and delivery information of the product(s) on the SELLER's website, and provided the necessary confirmation electronically. The BUYER further acknowledges, declares, and undertakes that they have received correct and complete information about the address, basic features of the ordered products, their prices including taxes, payment and delivery details before confirming the order.

8.2. The product subject to the contract shall be delivered to the BUYER or the person/organization specified by the BUYER at the address indicated in the pre-information section on the website, within the time specified, depending on the distance to the BUYER’s place of residence, without exceeding the 30-day legal period. If the product is not delivered within this period, the consumer may terminate the contract.

8.3. The SELLER undertakes to deliver the product in accordance with the specifications of the order, free from any defects, and accompanied by any applicable warranty certificates, user manuals, and other necessary information and documents, in a manner that complies with legal regulations and quality standards, maintaining and improving service quality, and acting with care and foresight during the execution of the transaction.

8.4. The SELLER may provide a different product of equal quality and price, after informing the BUYER and obtaining their explicit consent, if the product subject to the contract cannot be delivered before the performance obligation expires.

8.5. If it becomes impossible to deliver the ordered product or service, the SELLER agrees to notify the BUYER in writing or through a permanent data carrier within three (3) days from learning about the situation and to refund all payments, including any delivery costs, to the BUYER within 14 days.

8.6. The BUYER agrees to confirm the contract electronically for the delivery of the product. If the product price is not paid or the payment is cancelled in the bank records for any reason, the SELLER’s obligation to deliver the product will terminate.

8.7. In the case that the product is delivered and the BUYER's credit card is misused by unauthorized persons, resulting in the non-payment of the product by the relevant bank or financial institution, the BUYER agrees to return the product within 3 days to the SELLER at the SELLER's expense.

8.8. If the SELLER cannot deliver the product within the agreed time due to unforeseeable force majeure events, they agree to notify the BUYER within three (3) days. The BUYER may request cancellation of the order, replacement with an equivalent product, or delay the delivery until the hindrance is removed. If the order is canceled, the SELLER will refund the product amount within 14 days if the BUYER paid by cash, or within 14 days to the relevant bank if the BUYER paid by credit card.

8.9. The SELLER has the right to contact the BUYER via the contact details provided in the registration form or later updated by the BUYER for communication, marketing, notifications, and other purposes. The BUYER accepts and declares that the SELLER may engage in such communication activities.

8.10. The BUYER shall inspect the product before accepting delivery. If the product is damaged, broken, or has its packaging torn, the BUYER should refuse to accept it. Once the product is accepted, it is assumed to be undamaged. The BUYER is responsible for the product’s protection after delivery. If the right of withdrawal is exercised, the product must not have been used.

8.11. If the credit card holder is not the same person as the BUYER, or if a security breach is detected in the credit card used before the product is delivered, the SELLER may request the BUYER to submit their identification and communication details, the previous month's credit card statement, or a statement from the bank confirming that the credit card belongs to them.

10. RIGHT OF WITHDRAWAL

10.1. The BUYER has the right to withdraw from the distance sales contract within 14 (fourteen) days from the delivery of the product to the BUYER or the person/organization specified by the BUYER, without giving any reason. For service contracts, the withdrawal period starts from the date the contract is signed. The BUYER must notify the SELLER within this period that they wish to exercise the right of withdrawal. The SELLER will inform the BUYER before the agreement is made, in clear and understandable terms, of the obligations they will incur once the contract is accepted.

10.2. The notification of withdrawal must be made in writing within 14 days via registered mail, fax, or email, and the product must be unused, in its original packaging, and with any included accessories. If this right is exercised, the SELLER is obligated to refund all payments and return any documents within 14 days.

11. PRODUCTS THAT CANNOT BE RETURNED

The right of withdrawal cannot be exercised for goods that are made according to the BUYER's specifications, or those that are unsuitable for return due to their nature (e.g., personal care items, lingerie, swimwear, and products that are perishable or likely to expire).

12. DEFAULT AND LEGAL CONSEQUENCES

If the BUYER defaults on any credit card payments, they agree to pay interest and be responsible for the payment under the terms of their agreement with the bank. In case of default, the bank may seek legal action, and the BUYER will be liable for any damages suffered by the SELLER.

13. JURISDICTION

13.1. The BUYER agrees that the competent consumer arbitration committees and consumer courts in the place of residence of the BUYER or the place where the goods/services were purchased shall have jurisdiction over disputes arising from this Agreement.

13.2. Complaints and objections may be made to the Consumer Arbitration Committee or Consumer Court in the place where the goods/services were purchased or where the BUYER resides.

14. EFFECTIVENESS

By making payment for an order placed on the site, the BUYER acknowledges that they have accepted all the terms of this Agreement. The SELLER is responsible for ensuring that the BUYER cannot place an order without confirming that they have read and accepted the terms of this Agreement.
